Welcome to MixSense. These Terms of Use ("Terms") govern your access to and use of the MixSense application ("App"), website, and related services (collectively, the "Service") provided by MixSense ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

MixSense is an ear training and mixing education platform available on iOS, Android, and the web. The Service provides interactive audio exercises, gamified lessons, progress tracking, and related features designed to help music producers improve their mixing skills.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.

3. Accounts

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@mixsense.co if you suspect unauthorized access.

4. Free & Premium Features

4.1 Free Tier

MixSense offers a free tier that provides access to core ear training exercises, daily sessions, progress tracking, and the Ear Score system. Free users are not blocked from training — you can continue to use and benefit from the App without a paid subscription.

4.2 Premium Subscription

We offer optional premium subscription plans ("Premium") that unlock additional content, features, and capabilities. The specific features, pricing, and subscription periods are presented within the App at the time of purchase.

4.3 Free Trials

Certain subscription plans may include a free trial period. The duration and terms of the trial are disclosed before you subscribe. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable fee.

5. Subscriptions, Billing & Cancellation

5.1 Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly or annually, depending on the plan you selected) unless you cancel before the renewal date.

5.2 How to Cancel

• iOS: Go to Settings → Apple ID → Subscriptions → MixSense → Cancel Subscription.
• Android: Go to Google Play Store → Menu → Subscriptions → MixSense → Cancel Subscription.
• Web: Manage your subscription through your account settings at app.mixsense.co, or contact us at support@mixsense.co.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that period ends. No partial refunds are issued for unused portions of a billing period.

5.3 Payment Processing

Payments for subscriptions purchased through the App are processed by Apple (App Store), Google (Google Play), or Stripe (web), depending on your platform. We do not directly store your payment card details. All transactions are subject to the terms and refund policies of the respective payment processor.

5.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle after notice has been provided. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Intellectual Property

All content, materials, features, and functionality of the Service — including but not limited to audio samples, exercises, text, graphics, logos, and software — are owned by MixSense or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Copy, reproduce, distribute, or create derivative works from any content provided through the Service.
• Use automated tools, bots, or scrapers to access the Service.
• Interfere with the operation or security of the Service.
• Share, transfer, or sell your account or subscription to another person.
• Record, redistribute, or publicly perform any audio content from the Service.

8. User Content

If the Service allows you to submit, post, or share content (such as comments, feedback, or community contributions), you retain ownership of that content but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it in connection with the Service. You are solely responsible for any content you submit and represent that you have the right to share it.

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including authentication providers (e.g., Google OAuth), analytics services, and payment processors. Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant that any particular learning outcome or improvement in mixing skills will result from using the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MixSense and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Service, including but not limited to loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will continue to apply (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law).

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of them.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the competent courts of Israel.
